The Licensing
Commission investigated the incident after it received an
email complaint.
An investigation
found security guard Saner Chaiyapoe approached a man who
was annoying patrons in March to remove him from the
markets.
The man, known
only as Peter, immediately punched the guard three times,
the commission said.
A shop manager
wrestled the man to the ground and Mr Chaiyapoe kicked him
twice near his head, the commission said.
The security
guard told the commission he was stunned and disoriented
after being punched and was trying to help the manager
restrain the man.
The commission
found the use of force was unnecessary and unreasonable.
It suspended the
guard's security officers licence for three days and
suspended his crowd controllers licence for six months.
In a separate
decision, a Darwin bouncer has been given a reprimand for
using undue force against a bar patron.
The commission
held an inquiry after Colin Belle complained about how he
was treated by security guard Gene Hocking at the
Shenanigans Bar in August last year.
Mr Belle was
told to leave the bar by Mr Hocking, but Mr Belle refused
and argued with the bouncer.
The commission
said the guard held Mr Belle around the neck and pushed him
to the ground.
Mr Belle told
the inquiry he was being unfairly victimised and had been
refused entry to a number of bars where Mr Hocking worked.
The commission
viewed security camera footage and found the guard had used
undue force.
It said the
penalty was reduced for a number of reasons, including that
Mr Belle inappropriately provided materials from the hearing
to the local newspaper, which ran a front page story about
it.
